Experts believe that the revised law of promoting civilian run education, the organizers, participants, regulators and consumers, goal and direction of the development of private education more clear definition of responsibility, rights and benefits more clearly, will be conducive to encourage and support the sustained and healthy development of all types of private education. 小学初中或禁办营利民校   新华社北京10月31日电 (记者王思北、刘奕湛)民办教育促进法修正案草案31日提交十二届全国人大常委会第二十四次会议进行三审。草案新增加规定,不得设立实施义务教育的营利性民办学校。   根据修正案草案二次审议稿,民办学校的举办者可以自主选择设立非营利性或者营利性民办学校。   全国人大法律委员会副主任委员李连宁向大会作说明时表示,有的常委会委员、地方和社会公众提出,在义务教育领域,应当限制举办营利性民办学校。教育部还提出,根据党中央精神,不允许举办营利性民办义务教育阶段学校,建议予以明确。经研究,建议增加规定:“不得设立实施义务教育的营利性民办学校。”   “义务教育具有公益性、普惠性、免费性和强制性的特点,是各级地方政府尤其是县区级人民政府必须‘兜底’保障的教育。从法律层面讲,它既是权利,更是各级政府以及适龄少年儿童的法定监护人应尽的义务。”江苏省泰州市教育局副局长、法学博士封留才说,近年来我国民办教育发展十分迅速,但由于制度设计不够完善,基层政府对民办学校的监管缺少法律依据,“假民办”问题依然存在,使民办教育的健康发展受到影响,消费者的合法权益也无法保障。   为加强对民办学校办学行为的监督和管理,草案提出,民办学校应当设立学校理事会、董事会或者其他形式的决策机构并建立相应的监督机制。民办学校的举办者依据学校章程规定的权限和程序参与学校的办学和管理。   专家认为,此次修订民办教育促进法,对举办者、监管者、参与者以及消费者来说,民办教育发展的目标、方向更加清晰,责、权、利的界定更加明确,将有利于鼓励、支持各级各类民办教育持续健康发展。相关的主题文章:
